MCM Plumbing – Terms & Conditions and Service Disclaimers
1. Overview
By using our services, submitting a service request, or visiting our website, you acknowledge and agree to the terms and conditions outlined in this document. These terms form a binding agreement between the customer (or authorized representative) and MCM Plumbing. This content is provided for general information and advertising purposes only. It does not represent a comprehensive or contractual promise of services or outcomes and shall not be interpreted as such by insurers, inspectors, regulators, or other third parties.
2. Contractor Licensing
We are fully licensed by the California Contractors State License Board (CSLB) with the following classifications:
- Class A – General Engineering Contractor
- C-36 – Plumbing Contractor
- C-34 – Pipeline Contractor
License classifications define general authority to perform certain types of work but do not supersede state, county, or city permit requirements. The presence of a license does not guarantee insurance coverage for all work unless it is declared to the insurer and covered in the written agreement. All services are performed or directly supervised by licensed professionals. We comply with all relevant state and local codes.
3. Free Estimates
- Free estimates apply when:
- A clear description of the requested service is provided
- Photos, plans, or specifications are submitted prior to the estimate
- Diagnostics not included:
- Services such as camera inspections, disassembly, or investigative troubleshooting (e.g., opening walls, digging, or testing) may incur additional fees
- We will notify you before performing any billable diagnostic work
- Non-binding: Estimates are valid for 30 days and subject to change based on jobsite conditions or further discovery
4. Permit Responsibility
Permits, inspections, and agency approvals are the responsibility of the customer unless explicitly included in the signed contract. MCM Plumbing may assist in coordination but is not liable for delays, denials, or regulatory outcomes outside our control.
5. Scope of Work
Estimates are based on visible or disclosed conditions. If concealed issues (e.g., root intrusion, corrosion, structural damage) are discovered, work will pause, and a revised quote will be issued for your approval.
6. Service Area
Our core service region includes Merced and surrounding Central Valley communities. Travel or mobilization fees may apply outside this region.
7. Warranty
- Residential Work: One-year workmanship warranty unless otherwise stated
- Drain Cleaning: 30-day limited warranty on the same drain and blockage
- No warranty if the line is broken, misaligned, has root intrusion, or lacks an accessible cleanout
- Warranty is voided by improper use such as flushing grease, wipes, or foreign objects
- Hydro-Jetting: 90-day limited warranty (case-by-case), valid only with cleanout access
- Commercial, Industrial, Agricultural: No warranties provided on drain systems
- Camera Inspections: Diagnostic only, no warranty
- Parts: Covered by manufacturer warranty; we assist with claims when possible
8. Payment
Payment is due upon job completion unless other arrangements are made in writing. We accept credit cards, checks, and ACH payments. Late payments may incur a 1.5% monthly fee or the maximum allowed by law.
9. Liability
- Not responsible for pre-existing conditions
- Not liable for prior or future work by other contractors
- Not responsible for damages due to hidden conditions or unknown system defects
- We do not insure system performance or guarantee future operation
- Liability is limited to the total amount paid for our services unless otherwise required by law
10. Cancellations
24-hour notice required. Missed or late cancellations may be subject to a trip charge.
11. Updates
Terms and conditions are subject to change. The most current version is always available at www.mcmplumbing209.com.
12. Customer Responsibilities
- Provide clear, safe access to the work area
- Secure pets and restrict access to children and unauthorized individuals
- Disclose known hazards, jobsite limitations, or HOA restrictions
- Notify MCM Plumbing of required access times, noise limits, or any site-specific restrictions prior to work
13. Third-Party Materials & Labor
We are not responsible for compatibility, performance, or defects in materials or labor provided by others.
14. Dispute Resolution
Any disputes must be resolved through good-faith negotiation or small claims court in Merced County, California. California law governs this agreement.
15. Trademarks
“MCM Plumbing” and associated branding are registered property. Unauthorized use is prohibited.
16. Subcontractors
All subcontractors must carry valid insurance and workers’ compensation and must list MCM Plumbing as an additional insured party.
17. No Design or Engineering Services
MCM Plumbing does not provide architectural, engineering, or structural design services. Any such liability is expressly disclaimed.
18. Project Scope Limitations
- No work above two stories
- No landfill, hazardous material, or OCIP/wrap-insured jobs unless agreed in writing
19. Hold Harmless & Indemnification
Customer agrees to hold MCM Plumbing harmless against any third-party claims unless arising from our gross negligence or willful misconduct.
20. Insurance Exclusions
- No coverage for mold, asbestos, lead, or hazardous materials
- No coverage for design liability, cyber events, pandemics, war, or terrorism
- Our general liability and workers’ compensation coverage only applies to services within the lawful scope of license, written contract, and jobsite conditions
Customer agrees not to pursue claims related to these exclusions.
21. Nonrefundable Fees
Trip, permit, and inspection fees are fully earned once service is initiated and are nonrefundable.
22. Financing & Deposits
Deposits are nonrefundable once work begins. Cancellations may result in administrative or restocking fees.
- Per California law: Residential contracts over $500 are limited to a $1,000 deposit or 10% of the contract value, whichever is less
23. Right to Cancel (Residential Only)
For agreements signed at your home or off-site, you have three business days to cancel under California law. Cancellations must be submitted in writing before midnight on the third business day.
24. Mechanics Lien Warning
Anyone who provides labor or materials to improve your property and is not paid may have the right to file a lien. Pay your contractor directly and request lien releases to avoid legal issues. (California Civil Code §8200 et seq.)
25. CSLB Verification
You may verify our license status at www.cslb.ca.gov. MCM Plumbing is licensed and insured under California law.
Service Disclaimers
1. Trenchless Services
Trenchless utility methods—including pipe bursting, pipe thrusting, and directional boring—are performed in accordance with applicable codes and best practices. Subsurface conditions (soil composition, water table, unmarked utilities) may impact results. We are not liable for damages caused by concealed or unmarked obstacles. Engineering, easements, and permits may be required. Post-installation engineering certification is excluded unless stated in writing.
2. Hydro Jetting & Drain Cleaning
High-pressure jetting and mechanical cleaning remove blockages but do not fix pipe structure. Older, deteriorated, or misaligned piping may break or collapse during service. We are not liable for damage caused by pre-existing pipe defects. Video inspection is recommended. If jetting or cleaning equipment becomes lodged, damaged, or requires retrieval due to system condition, the customer is responsible for all associated costs.
Jetting of septic leach lines is provided without warranty. No warranty applies to drains with root intrusion, improper slope, or damaged pipe.
3. Backflow Testing & Certification
Testing is conducted per AWWA standards and local rules. Passing reflects only the condition at the time of test. No warranty is offered on future functionality. We are not responsible for failures, contamination, or tampering after the test is completed. Customers are responsible for annual re-testing and repairs.
4. Gas Line Services
All gas services are performed by licensed professionals in accordance with current safety codes and local regulations. MCM Plumbing is not responsible for customer-supplied materials, unlabeled or inaccurately marked utilities, or concealed site hazards. We conduct post-installation pressure testing where applicable, but final inspection and approval by the Authority Having Jurisdiction (AHJ) is the responsibility of the customer unless otherwise stated in writing.
We are not responsible for:
- Damage caused by third-party utility strikes or municipal infrastructure issues
- Any delays caused by permit processing or regulatory inspection timelines
- Compatibility issues or failures arising from existing gas appliances or fixtures
- Gas system failures resulting from seismic activity, soil movement, or environmental conditions beyond our control
All liability is limited to the scope of services we directly perform. We do not guarantee uninterrupted service or long-term system integrity beyond the final test at the time of installation. Customers are responsible for arranging and maintaining access for inspectors, utility representatives, or follow-up personnel.
5. Water Heater Services
Installation and replacement of water heaters include diagnostic and start-up services. No warranty is offered on customer-supplied units. Manufacturer warranties apply where applicable. We are not responsible for unit failure, leaks, electrical issues, pressure relief valve discharges, code compliance problems, or compatibility concerns if we did not supply and install the complete system.
We are not liable for:
- Pre-existing plumbing or venting issues
- Inadequate water pressure, mineral buildup, or water quality problems
- Failures due to undersizing or oversizing dictated by customer preference
- Local utility provider shutdowns, code enforcement changes, or equipment recalls
All services are performed per applicable code requirements at the time of installation. Long-term performance is dependent on proper maintenance, water conditions, and usage practices, which are the customer’s responsibility.
6. Excavation Services
We perform all digging in compliance with Cal/OSHA, utility marking (811), and safe work practices. We are not responsible for damage to unmarked lines, abandoned tanks, irrigation, concrete, buried debris, or septic system components.
Additional charges may apply if:
- Rock, concrete, tanks, or hardpan are encountered
- Dewatering or shoring is required due to site conditions
- Permit conditions require engineered backfill or compaction testing
No warranty is provided regarding ground conditions, soil settlement, vegetation disruption, or restoration beyond the specific scope of work. MCM Plumbing is not responsible for delays caused by inspection hold-ups or weather-related conditions. It is the customer’s responsibility to disclose known underground conditions and provide access.
7. Repiping Services
Repiping includes replacement of piping only unless specifically stated. We are not liable for:
- Damage to walls, floors, ceilings, fixtures, or landscaping unless explicitly included
- Failures or leaks in retained existing valves, hose bibs, supply lines, or fixtures
- Water quality issues, noise, thermal expansion, or customer plumbing design limitations
All repiping work is performed to current California plumbing code standards. Cosmetic restoration (e.g., drywall, texture, paint, flooring, tile) is excluded unless expressly stated in writing. If hazardous materials, inaccessible framing, structural issues, or unusual routing is discovered, work may be paused, and the customer will receive a revised estimate.
Customers are responsible for:
- Ensuring fixture access
- Verifying valve operation
- Arranging post-repipe testing, insulation, or local permitting follow-up unless specified
Finish restoration (paint, drywall, tile, etc.) is excluded unless included in writing. Work is performed to current California code. If hazardous materials, structural obstacles, or corroded components are found, we may revise the scope and cost.
8. Property Restoration
We do not restore disturbed surfaces unless explicitly included. Concrete, asphalt, landscape, drywall, paint, and finishes are the responsibility of the property owner unless otherwise stated in the contract.
9. Property Damage
We are not responsible for incidental damage required to access concealed plumbing. All due care is used, but necessary cuts to drywall, cabinets, or flooring are the owner’s responsibility unless stated otherwise.
10. Safety & Access
Customers must ensure a safe and interruption-free worksite. Pets must be secured and children kept away. We reserve the right to stop work if conditions are unsafe or disruptive. Additional charges may apply if delays occur.
11. Disclaimer of Results
We make no guarantees of long-term system performance beyond the scope of service provided. All plumbing systems are subject to failure due to age, condition, or external factors. Warranty exclusions and disclaimers apply.
12. Work Documentation & Photography
MCM Plumbing may document jobsite conditions, progress, and completion via photos or video for internal use, quality assurance, training, advertising, or dispute resolution. Images and footage may also be used for marketing purposes on our website, social media, or other promotional materials, unless the customer submits a written request opting out prior to publication.
13. Call, Vehicle & Equipment Tracking Disclosure
MCM Plumbing reserves the right to record inbound and outbound phone calls for training, quality assurance, and dispute resolution purposes. By calling our office, accepting a call, submitting a service request, or engaging our services, you consent to potential recording.
Our service vehicles and select equipment may be equipped with GPS tracking, dash cameras, or other monitoring technology. This equipment is used for technician safety, theft prevention, route optimization, jobsite documentation, and liability protection. Certain tools or equipment may also include onboard cameras to document worksite conditions and deter tampering or theft.
All recordings, images, audio files, and GPS data are the exclusive property of MCM Plumbing. By allowing MCM Plumbing access to your property, you acknowledge and consent to the potential recording of work areas and activity during service visits. MCM Plumbing reserves the right to use this material for any lawful purpose, including but not limited to legal defense, employee training, quality control, operational review, marketing, or incident investigation. Recordings will not be released publicly except as legally required or deemed necessary in formal claims or disputes.
Our office and yard facilities are also monitored by video surveillance systems for the safety and security of our staff, customers, visitors, property, and equipment. All surveillance footage is retained in accordance with internal policies and may be used for lawful operational, investigative, or legal purposes.
